RIGHT TO A HIGHER BID
OF THE SEA-GOING VESSEL "SORMOVO IV"
“ex-VAMA, ex-MAJOR” (date of construction 1983 – gross tonnage 2.478 tons)

Provisionally adjudicated for only 1 EUR increased by a fixed percentage of 15% for costs

By act of provisional adjudication under the suspensive condition of absence of a higher bid, dated the 30th of September 2017,  Cedric Vergauwen, deputy judicial officer acting instead of Robert Vergauwen, judicial officer in Ghent (Belgium), Gewad 36,  has adjudicated the sea-going vessel SORMOVO IV for an amount of 1 EUR increased by a fixed percentage of 15%.
The sea-going vessel SORMOVO IV is currently moored in the Port of Ghent – Belgium, Quay 1020

Article 1592 of the Judicial Code: "Any person has the right to make a higher bid during a period of fifteen days following the adjudication. The higher bid must not be less than one tenth of the principal amount of the adjudication, with an absolute minimum of EUR 250.00 and a maximum of EUR 6,200.00, which may, but must not be exceeded. This amount will have to be consigned at the office of the notary* at the time when the higher bid is made; notice of this higher bid must be served upon the notary* by writ of a judicial officer, which writ must be notified to the buyer. The adjudication following the higher bid will be performed by the same notary* and in the same way as the original adjudication. This adjudication – which is open to all – is final. The notary* can reject the higher bid of persons unknown to him or whose identity or solvency appear not to have been proven. He can in all instances require a deposit** from the higher bidder. Should the notary* refuse a higher bid, he will immediately make an official record of same, stating the reasons for his refusal. In all instances the applicants can because of special circumstances either state in the conditions of sale or decide during the sale procedure that the formality of the higher bid will not apply."
*For notary public one needs to read “judicial officer”
**The security must be given in the form of a guarantee of 250.000 EUR

The ship can be inspected after appointment with the office of the legal officer in charge and with an entry ticket provided upon entry of the vessel.
The bidders and buyers need to produce a bank guarantee of 250.000 EUR .
