Vessel: M/V “MSC Daniela”
Case: (1) COMPANIA NAVIERA DANIELA S.A. and (2) MSC MEDITERRANEAN SHIPPING COMPANY S.A. v (1) LG CHEM LTD and (2) AND ALL OTHER PERSONS CLAIMING OR BEING ENTITLED TO CLAIM DAMAGES BY REASON OF THE CASUALTY SUFFERED BY THE SHIP M/V “MSC DANIELA” IN THE INDIAN OCEAN OFF COLOMBO, SRI LANKA, ON 4 APRIL 2017 AND THEREAFTER. Claim No: AD-2017-000127.
The claim relates to an incident whereby a fire broke out onboard the Vessel at or about 8:30 hours on 4 April 2017, whilst underway off Colombo, Sri Lanka, and whilst it was performing a liner service from Dalian, China, to Port Said, Egypt. Compania Naviera Daniela S.A., the registered owner of the Vessel, and MSC Mediterranean Shipping Company S.A., the demise charterer of the Vessel, have obtained a Limitation Decree dated 22 March 2018 from the Admiralty Court, Queen’s Bench Division of the High Court of Justice in London limiting their liability in relation to this incident to 61,172,818 Special Drawing Rights, pursuant to the Merchant Shipping Act 1995.
A Limitation Fund has been constituted.
Any party wishing to apply to set aside the said Limitation Decree must file an application at the Admiralty Court no later than 1600 on 30 April 2018. The application should also be served on the Claimants’ Solicitors, Mills & Co, no later than 1600 on 30 April 2018 either by first class post or via e-mail (the details for service are set out below).
Any party wishing to file a claim against the Limitation Fund must file a claim on an ADM20 form at the Admiralty Court no later than 14 May 2018 and must serve the ADM20 form on the Claimants’ Solicitors, Mills & Co, no later than 14 May 2018 either by first class post or via e-mail (the details for service are set out below). Any party who files an ADM20 form is not obliged at the same time to file and serve a statement of case pursuant to CPR r. 61.11(15). The time for filing and serving of statements of case shall be subject to subsequent agreement of the parties or Order of the Admiralty Court.
