KINDLY TAKE NOTICE THAT on FRIDAY, 22 OCTOBER 2021, the above Court, issued a Rule Nisi calling on all persons interested to show cause before the High Court of Namibia on FRIDAY, 19 NOVEMBER 2021 at 10h00 or so soon thereafter as the matter may be heard why an Order should not be made in the following terms:

 

1.       That the MV “PRINCESS VANESSA” (hereinafter referred to as “the vessel”) be sold by public auction subject to confirmation by the Court.

 

2.       That the Deputy Sheriff for the district of Walvis Bay act as auctioneer for and on behalf of the Court in respect of the sale. The contact particulars of the auctioneer are as follows:

3.       That Advocate Jan Albert Nicolaas Strydom be appointed as Referee to receive, examine, consider and report to this Honourable Court upon the validity and ranking of claims against the Fund.

 

4.       That the sale shall be held not less than 21 calendar days and not more than 41 Calendar days after the return date for the confirmation of this order.

 

5.       That the auctioneer shall advertise the sale and the date thereof not less than five (5) calendar days before the sale once in “The Namibian” in Namibia and once in an International newspaper, the “TradeWinds”, ‘”Lloyds List” or ”Fairplay”.

 

6.       That the proceeds of the sale shall constitute a Fund in the High Court of Namibia and shall be dealt with in accordance with the provisions of the order.
