Marine accident reports remain inadmissible in English courts
Marine Accident Investigation Branch reports remain inadmissible in maritime disputes, the High Court has ruled, after that position was challenged following a precedent provided by the successful use of a parallel report from its air counterpart as evidence in civil proceedings
Mr Justice Teare has reaffirmed that detriment to incident investigations that might come about if MAIB reports were allowed to be used as evidence outweighs any benefit to commercial arbitration. The reports remain off-limits for commercial court disputes
