Court of Appeal confirms law on implied terms in sales of gasoil

THE 2010 Court of Appeal case of KG Bominflot Bunkergesellschaft fur Mineraloele mbH & Co v Petroplus Marketing AG questioned the implication of an additional term at common law into a contract for the sale of gasoil, and considered whether an exclusion clause effectively excluded terms implied by the Sale of Goods Act 1979 (“the Act”).
